This Privacy Policy explains how Pats Peak Skiing, LLC (“Pats Peak,” “we,” “us,” or “our”) collects, uses, shares, and protects information when you visit www.patspeak.com and any related pages, online stores, booking tools, and features we operate (collectively, the “Site”), and when you otherwise interact with us. Please read it carefully. By using the Site, you agree to the practices described here.

2. Information we collect

Information you provide to us

We collect information you give us directly, for example when you buy lift tickets, season passes, lessons, or gift cards; create or use an online account; reserve or book activities, banquets, weddings, or group events; upload a season pass photo; sign up for our email newsletter; enter contests or promotions; submit a contact, group, banquet, donation, or employment form; or use our live chat. Depending on what you do, this may include:

  • Identifiers and contact details — name, postal address, email address, and telephone number.
  • Account and order information — username, order history, reservations, preferences, and customer service communications.
  • Payment information — payment card and billing details, which are processed by our third-party payment processor(s); we do not store full payment card numbers on the Site.
  • Content you submit — photos, comments, reviews, contest entries, and information in forms or chat messages, which may include your hometown or other details you choose to share.
  • Employment information — if you apply for a job, the information in your application and resume.

Information we collect automatically

When you use the Site, we and our service providers automatically collect certain information through cookies and similar technologies, including:

  • Device and connection data — IP address, device and browser type, operating system, language, and referring/exit pages.
  • Usage data — pages viewed, links clicked, dates and times of access, and how you navigate the Site.

Information from third parties

We may receive information from third parties, such as payment processors (transaction confirmations), analytics and advertising providers, social media platforms when you interact with our pages or embedded content, and event or group organizers who provide attendee details.

3. How we use your information

We use personal information to:

  • Provide, process, and fulfill your purchases, passes, reservations, bookings, and requests.
  • Create and manage your account and provide customer service and support, including live chat.
  • Send transactional messages and, where permitted, marketing communications such as newsletters and promotions (you can opt out at any time).
  • Operate, maintain, secure, and improve the Site and our products, programs, and services.
  • Understand site usage and measure and improve the performance of our content and marketing.
  • Run contests, sweepstakes, and promotions, and publish submitted content where you have agreed.
  • Comply with legal obligations, enforce our terms, and protect the rights, property, and safety of Pats Peak, our guests, and others.

4. Cookies and similar technologies

Managing your choices. When you first visit the Site, our cookie banner lets you accept or manage non-essential cookies. Performance, analytics, and advertising technologies are not loaded until you consent through the banner. You can change your choices at any time using the cookie settings link on the Site, and you can also control cookies through your browser settings. Note that disabling some cookies may affect how the Site works.

Global Privacy Control (GPC). Where required, we treat a recognized opt-out preference signal, such as Global Privacy Control, as a request to opt out of the “sale” or “sharing” of personal information for the browser or device on which we receive it.

5. Analytics and online advertising

Subject to your consent, we use Google Analytics (delivered through Google Tag Manager) and Cloudflare performance monitoring to understand how the Site is used. We may also use Google advertising services to measure and, where applicable, deliver advertising. These providers may set their own cookies and process information such as your IP address and online activity.

You can opt out of Google Analytics across websites using Google’s browser add-on at tools.google.com/dlpage/gaoptout. You can manage interest-based advertising at optout.aboutads.info (Digital Advertising Alliance) and optout.networkadvertising.org (Network Advertising Initiative).

6. Live chat, communications, and your consent to recording

Our live chat feature is operated by Pats Peak. When you use live chat, submit a form, or otherwise communicate with us electronically, we collect and store the contents of those communications to respond to you and for customer service, quality assurance, training, security, and recordkeeping.

Consent to monitoring and recording. By using our live chat, submitting information through our online forms, or otherwise communicating with us through the Site, you consent to Pats Peak collecting, recording, storing, and monitoring those communications as described in this Policy. If you do not consent, please do not use these features; you may instead contact us by phone or postal mail using the details in Section 1.

7. How we share information

We do not sell your personal information for money. We may share personal information in the following ways:

  • Service providers. With vendors who perform services for us — such as payment processing, hosting, email delivery, analytics, advertising, and customer support — who are permitted to use the information only to provide those services to us.
  • Advertising and analytics partners. With analytics and advertising providers as described in Sections 4 and 5. Depending on your state, the use of advertising cookies may be considered “sharing” or a “sale” for cross-context behavioral advertising; you can opt out as described in this Policy.
  • Legal and safety. When required by law or legal process (such as a subpoena or court order), to law enforcement, or to protect the rights, property, or safety of Pats Peak, our guests, or others.
  • Business transfers. In connection with a merger, acquisition, financing, or sale of assets.
  • With your direction. When you ask us to share information, or when you post content publicly.

We do not share personal information with unrelated third parties for their own marketing without giving you an opportunity to opt out.

8. Your privacy rights and choices

Marketing opt-out

You can unsubscribe from marketing emails using the link in any message, or by contacting us. We may still send you non-promotional messages about your purchases, account, or reservations.

California residents (CCPA/CPRA)

If you are a California resident, and to the extent the law applies to us, you have the right to: know and access the personal information we have collected about you; request deletion of your personal information; request correction of inaccurate personal information; opt out of the “sale” or “sharing” of personal information; and not be discriminated against for exercising your rights. To exercise these rights, contact us using the details in Section 1 or use the cookie settings and opt-out tools on the Site. We will verify your request and may ask for information to confirm your identity. You may use an authorized agent to submit a request on your behalf.

California “Shine the Light.” California Civil Code § 1798.83 permits California residents to request information about disclosures of personal information to third parties for their direct marketing purposes. You may make such a request using the contact details in Section 1.

Other U.S. state privacy rights

Residents of certain other U.S. states may have similar rights to access, correct, delete, or obtain a copy of their personal information, and to opt out of targeted advertising or the sale of personal information. To exercise any of these rights, contact us using the details in Section 1. If we deny your request, you may appeal by replying to our response.

9. Data retention

We keep personal information for as long as needed to provide our products and services, maintain your account, comply with our legal and tax obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we take reasonable steps to delete or de-identify it.

10. Data security

We maintain reasonable physical, electronic, and administrative safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Children’s privacy

The Site is intended for a general audience and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us personal information, please contact us and we will take appropriate steps to delete it. Information about minors enrolled in lessons, programs, or events is provided by a parent or guardian.

12. Third-party links and sponsors

The Site contains links to third-party websites, social media platforms, and sponsors, and may feature content or promotions co-branded with third parties. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing them with information.

13. Do Not Track

Some browsers offer a “Do Not Track” setting. Because there is no common industry standard for responding to these signals, the Site does not currently respond to Do Not Track signals, but we honor recognized opt-out preference signals as described in Section 4.

14. Changes to this Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Site after changes take effect means you accept the updated Policy.
